1. Data Controller
L&D Foodpartner BV, with its registered office at Noorwegenstraat 29D, 9940 Evergem, and with company number BE0768656308, trading under the name “Delmo” (hereinafter: “Delmo”), attaches great importance to the secure, transparent, and confidential collection and processing of your personal data in compliance with the General Data Protection Regulation (hereinafter: GDPR).
Delmo wishes to inform you through this privacy statement about the collection and processing of your personal data. We ask that you read this privacy statement carefully.
By providing your personal data to our company, you expressly acknowledge that you have read and unreservedly agree to this Privacy Statement.
Personal Data Processed
Delmo may process personal data about you because you use our services and/or because you provide this data to us yourself (e.g., via the contact form).
Since our webshop is accessible exclusively to businesses, we collect only business data and personal data of business contacts (B2B) through the webshop. We process the following: company name, business/VAT number, contact person’s name, business email address, business phone number, shipping and billing address, payment history, and technical data (IP address). For intra-Community deliveries, we verify the validity of your VAT number via the European VIES database.
For the purpose of our offline services, we process the data of both businesses and consumers. This includes identification and contact details (name, address, email, phone) and financial data necessary for the execution of the order.
Depending on your status as a visitor, business customer, or consumer customer, we process the following data:
• Identification and contact details (name, title, (delivery) address, email, phone number);
• Business data (B2B): company name, VAT number, business registration number.
• Financial data (account number, payment history, billing information, order history);
• Technical data (IP address, browsing behavior, browser information).
You are responsible for all data you provide to us. We rely on its accuracy. If your data is no longer up to date or changes, please notify us immediately in writing and/or update it in your online account.
3. Why Delmo processes data
Delmo processes data based on the following legal grounds and for the following purposes:
• Performance of the contract: to process, invoice, and deliver your (webshop) order and to keep you informed of the status of your order/repair.
• Legal obligation: for our accounting and tax obligations (including VAT returns, proof of intra-Community supply, and retention periods).
• Legitimate interest: for customer management, human resources and payroll administration, public relations, fraud prevention, and direct marketing to existing customers (you can unsubscribe from this at any time).
• Consent: for sending newsletters to non-customers or placing nonessential cookies.
The legal grounds are the performance of the contract, compliance with legal and/or regulatory obligations, and/or our legitimate interest.
4. How long Delmo retains data
Delmo does not retain your personal data longer than is necessary to achieve the purposes for which your data is collected
• Prospects: up to 1 year after the last meaningful contact.
• Customers (B2B & B2C): Billing and customer data are retained for 7 years after the relevant fiscal year to comply with our legal accounting and tax obligations.
• To safeguard our rights in the context of contractual disputes (legal claims), necessary data may be archived for up to 10 years after the end of the business relationship.
5. Sharing with Others
Delmo shares your personal data with third parties only if this is necessary for the provision of services or the performance of an agreement with you, or to comply with a legal obligation.
• Logistics partners (e.g., DHL) for the delivery of orders in Belgium and other EU member states (B2B only);
• Payment providers (e.g., Mollie) for processing online payments;
• IT service providers: software suppliers and hosting partners;
• Government agencies, tax authorities (if required by law);
• Others, e.g., acquiring party/advisor/… in connection with reorganization, transfer of activities, bankruptcy (and related matters).
We enter into data processing agreements with these partners to ensure the same level of security and confidentiality for your data. Under no circumstances will we sell your personal data to third parties.
We will make reasonable efforts to inform you in advance regarding the disclosure of your personal data to other third parties. However, you acknowledge and understand that in certain circumstances this may not always be technically or commercially feasible, or that legal restrictions may apply.
If data is transferred to parties outside the European Economic Area (EEA), this will only be done to countries with an adequate level of protection or based on the standard contractual clauses approved by the European Commission or the EU-US Data Privacy Framework.
For the purpose of processing your personal data, we grant access to your personal data to our employees, staff, and agents on a “need-to-know” basis. We ensure a similar level of protection by imposing contractual confidentiality obligations on these employees, staff, and agents that are consistent with this Privacy Statement.
6. Tracking website visits
On the Delmo website, general visit data is tracked, including your computer’s IP address, the time of the request, and data sent by your browser. This data is used to analyze visit and click behavior on the website in order to improve the website’s functionality. This data is anonymized as much as possible.
7. Google Analytics
Delmo uses Google Analytics to track how users use the website and how effective Delmo’s AdWords ads are on Google search results pages. The information obtained, including your computer’s address (IP address), is transmitted to and stored by Google on servers in the United States. This transfer is legally safeguarded under the EU-US Data Privacy Framework, for which Google LLC is certified.
Google uses this information to track how our website is used, to provide us with reports about the website, and to offer its advertisers insights into the effectiveness of their campaigns. Google may provide this information to third parties if Google is legally required to do so, or to the extent that these third parties process the information on Google’s behalf. Delmo has no influence over this. Delmo has configured the Google Analytics settings to be privacy-friendly and has not given Google permission to use the analytics information obtained via DELMO for its own, other Google services. 8. Your Rights
In accordance with and subject to the terms of Belgian privacy legislation and the provisions of the GDPR, you have the following rights:
• Right of access and inspection: You have the right to review the data we process about you free of charge
• Right to rectification: You have the right to have inaccurate or incomplete personal data corrected or completed.
• Right to erasure or restriction: You have the right to request that we erase your personal data or restrict its processing under the circumstances and conditions set forth by the GDPR. We may refuse to erase or restrict any personal data that is necessary for us to fulfill a legal obligation, perform the contract, or pursue our legitimate interests, and this for as long as such data is necessary for the purposes for which it was collected.
• Right to data portability: You have the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format. You have the right to transmit this data to another data controller.
• Right to object: You have the right to object to the processing of your personal data on serious and legitimate grounds, in particular to processing for direct marketing purposes. Please note that you cannot object to the processing of personal data that is necessary for us to fulfill a legal obligation, to perform the contract, or to pursue our legitimate interests, as long as this data is necessary for the purposes for which it was collected.
• Right to withdraw consent: If the processing of your personal data is based on your consent, you have the right to withdraw that consent at any time. Your personal data will then only be processed if we have another legal basis for doing so.

Delmo takes the protection of your data seriously and implements appropriate technical and organizational measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. Delmo’s website uses a reliable SSL certificate to ensure that your personal data does not fall into the wrong hands. Under no circumstances can Delmo be held liable for any direct or indirect damage resulting from the incorrect or unlawful use of personal data by a third party.
